Important Article about Classifying Appraisers as Independent Contractors in California (April 2018)

On April 30, 2018, the California Supreme Court issued a landmark decision that will impact the ability of appraisal firms and appraisal management companies (AMCs) to treat appraisers as independent contractors.  The case is called Dynamex v. Appraisers in Arbitration Published by the Appraisal Institute (April 2018)

Many of my clients are involved in real estate valuation, whether they are legal clients or insurance customers of LIA's E&O program. One future area of growth that I see for appraisers is arbitration. My friend Paula Konikoff, JD, MAI, AI-GRS, is a highly talented appraiser-arbitrator (and also one of the most sought after appraiser expert witnesses in the US). She has written a new book for the Appraisal Institute entitled Appraisers in Arbitration. The book helps appraisers with arbitration work.  I was lucky to be invited to write a chapter on liability issues for Paula's book. The point of my chapter is to help appraisers feel more comfortable risk-wise in the less familiar arbitrator role.
